Bac Giang Department of Industry and Trade was established under Decision No. 55/2008/QD-UBND dated June 30, 2008 of the Bac Giang People’s Committee on the basic of unification of the Department of Industry and the Department of Trade and Tourism.

       A. Functions:

The Department of Industry and Trade is the professional agency under the provincial People’s Committee. The department carries out the State management function on industry and trade, include mechanical, metallurgical, electrical, new energy, regenerate energy, chemical, industrial explosive materials, mine exploitation and processing of minerals, consumer industry, food industry, other processing industries, goods circulation in the province, export, import, border gate trading, market management, monopoly inspection, anti-dumping, consumers protection; e-commerce; trade services, economic integration, management of industrial clusters and points, industrial promotion activities, public services under the management scope of the department in the province.

 

B. Tasks and powers:

1. To submit to the provincial People’s Committee:

1.1. The planning drafts, long-term plans, five-year and annual plans; strategies, policies, program, measures and specific stipulations on the development of the industry and trade in the province;

1.2.The drafts of decisions and directives under the issuance competence of the provincial People’s Committee on industry and trade;

1.3. The drafts of stipulations on functions, tasks, power and organizational structures of the Market Management Department according to the provisions of the Government, guidance of the Ministry of Industry and Trade and competent State management agencies;

1.4. The drafts of stipulations on title standards for head and deputy-head of the agencies under the Department of Industry and Trade; the drafts of stipulations on title standards for industry and trade leaders of the Bureau of Industry and Trade under the People’s Committees of districts and Economic Bureau under the People’s Committee of Bac Giang city.

2. To submit to the president of the provincial People’s Committee:

2.1. The drafts of the decisions on establishment, merge and dissolve of agencies under the Department of Industry and Trade according to the provisions of law;

2.2. The drafts of the special decisions and directives under the issuance competence of the president of the provincial People’s Committee in industry and trade sector.

3. To guide and inspect the implementation of the legal documents, policies, planning, plans, projects, programs and other stipulations on industry and trade after the approval; to broadcast, guide and popularize legal knowledge in industry and trade sector.

4. To help the provincial People’s Committee to appraise the basic design of construction investment projects for the development of industry and trade in the province; to appraise, grant, amend, supplement, extend and revoke licenses and certificates under the management responsibility of the Department of Industry and Trade according to the provisions of law; the assignment or authority of the provincial People’s Committee.

5. Industry and small-scale industry

5.1. Mechanical and metallurgical sector:

To organize the implementation of the planning, plans, policies for the development of mechanical, mechano-electronics, metallurgy, mechanical products and spearhead mechano-electronic and hi-tech products.

5.2. Electricity and energy:

- To organize the implementation of the planning and plans for the development of electrical industry and application of new and renewed energy in the province;

- To do training legal knowledge on electrical operations and use for electrical units in the province; to do training professional and safety skills for cadres and technical workers under the rural electrical management organizations;

- To organize the implementation of electrical price projects in the province after the approval of the competent agencies;

- To coordinate with the State management competent agencies in carrying out examination and inspection activities according to the provisions of law.

5.3. Chemicals, industrial explosive materials and machineries and equipment with strict technical and safety requirements:

- To organize the implementation of the planning and plans for the development of the sectors related to chemicals, industrial explosive materials and machineries and equipment with strict technical and safety requirements in the province;

- To preside over and coordinate with the provincial relevant agencies in inspecting and handling of violations on management, use, preservation and transportation of chemicals, industrial explosive materials, liquefied gas and machineries and equipment with strict technical and safety requirements according to the provisions of law.

5.4. Mining exploitation and minerals processing industry (excluding minerals for construction materials and cement production):

- To preside over and organization of the implementation of the planning for exploration, exploitation and processing of minerals in the province after getting the approval of the competent agencies;

- To organize the implementation of the planning and plans for the development of mining exploitation and minerals processing industries in the province; to verify the implementation of the measures for environmental protection and safety stipulation in mining exploitation and minerals processing in the province.

5.5. Consumption, food and other processing industries:

- To organize the implementation of the planning, plans and development policies of the following sectors after getting the approval: textile-garment, leather-footwear, paper, porcelain, glass, plastic, beverage, tobacco, confectionery, milk, vegetable oil and powder processing;                                     

- To guide and inspect the implementation of the standards on the quality of industrial products, hygienic safety for industrial environment as well as food hygienic safety from the production to the circulation within the scope of management of the Department of Industry and Trade.

5.6. Industrial promotion:

- To deploy the implementation of industrial promotion programs, plans and projects in the province, using nation and local budget;

- To organization of training and enhancing the organization capabilities of implementation of industrial promotion activities for local cardes engaged in industrial promotion activities in the province.

5.7. Clusters, industrial and small-scale industrial points:

- To preside over and coordinate with the relevant agencies in organization of implementation of programs, projects, mechanisms, policies and plans for the development of small and medium-sized industrial enterprises, and economic organizations in the province; to approve the operation charters of those organizations;

- To deploy the implementation of preferential mechanisms and policies for attracting investment, import, export, tax, financial, labor mechanisms and policies; building technical infrastructures, ground clearance and transferring production bases; building new industrial and small-scale clusters and points in the province after getting the approval.

6. Trade

6.1. Domestic trade:

- To organize the implementation of planning, plans, mechanisms and policies for the development of trade infrastructural networks for wholesale and retail sale include markets, trade centers, system of supermarkets and workshops, trade cooperatives, trade services and system of trade agents;

- To preside over and coordinate with the relevant agencies in guiding and organizing the implementation of mechanisms and policies for encouragement of expansion of business network, development of good circulation, set up goods circulation channels;

- To implement preferential mechanism and policies for supporting production and business activities ethnic people in mountainous and remote areas in the province; 

- To summarize and settle market information on goods circulation volume, supply and demand, reserve and price changes of main items. To suggest measures to regulate goods circulation for each period.

6.2. Import and export:

- To organize the implementation of policies, plans, programs and projects for development and push up exports as well as development of import and export services in the province;

- To manage the import and export activities of domestic and foreign invested enterprises and foreign trader without representative in Vietnam, which is doing business in the province.

6.3. E-Commerce:

- To preside over and coordinate with the relevant agencies in building infrastructures for application of E-commerce in the province;

- To deploy the implementation of policies, plans and programs for development of human resources for management of E-commerce in the province.

6.4. Trade promotion:

- To organize the implementation of trade promotion programs, plans and projects for strengthening exports and supporting enterprises in the province to build and develop Vietnam’s trademarks.

- To organize the implementation, inspection and control of registration for organization of trade fairs and exhibitions, promotion programs for traders. 

6.5. Market management:

- To organize the implementation of the market management activities in the province according to the stipulation of the Government, guidance of the Ministry of Industry and Trade and other competent State management agencies;

- To guide and inspect the observation of the provisions of law in the sector of industry and trade of organizations and individuals, which participate in business activities in the province; to carry out professional inspection according to the provisions of law;

- To preside over and coordinate with the relevant agencies in fighting against smuggle activities and activities of trading in counterfeits, strictly and timely handle the speculatition activities of organiations and individuals in the province.

6.6. Competition, fighting against monopoly, anti-dumping and protection of consumers’ interests:

- To guide and organize the implementation of the provisions of law on competition, fighting against monopoly, anti-dumping, subsidize, protect consumers’ interests and ensure the fair competitive environment in the province. To propose the relevant agencies in amending and supplementing non-suitable stipulations and documents;

- To ask relevant organizations and individuals in the province to provide necessary information and documents for the implementation of tasks related to competition, fighting against monopoly, anti-dumping and protection of consumers’ interests;

- To collect, build databases, manage and provide information about competitive rules for strong enterprises in the market, monopoly enterprises, which have head offices in the province.

6.7. Economic integration:

- To deploy the implementation of concrete plans, programs and measures on economic integration and international trade in the province after getting approval;

- To preside over and coordinate with the relevant agencies in disseminating and guiding the implementation of plans, programs and rules for international economic and trade integration of the locality.

7.  To help the provincial People’s Committee on State management for enterprises, economic organizations and households; to guide and inspect the activities of associations and non-governmental organization operating in industry and trade sector in the province according to the provisions of law.

8. To guide and inspect the self-control and self-responsible mechanisms of State administrative units under the Department of Industry and Trade according to the provisions of law.

9. To carry out international cooperation in the field of industry and trade according to the provisions of law and the decentralization of the provincial People’s Committee.

10. To guide the industry and trade professional skills for bureaus of industry and trade under the People’s Committees of the districts and economic bureau under the People’s Committee of Bac Giang city.

11. To organize the implementation of plans on research, application of scientific and technological advances in industry and trade within the scope of management of the Department; to guide the application of economic-technical standards and norms; quality of industrial products; to build the systems of information storage, provide documents on industry and trade according to the provisions of law.

12. To deploy the implementation of administrative renovation programs of the Department according to the administrative renovations programs of the provincial People’s Committee.

13. To inspect and examine, handle of violations, denunciation, prevent and struggle against corrupt and negative activities; to carry out saving and fighting against misspending in the field of industry and trade according to the provisions of law and the decentralization of the provincial People’s Committee.

14. To organize the implementation of public services in the field of industry and trade within the scope of management of the Department according to the provisions of law.

15. To stipulate the functions, tasks, power, and organizational structures and working relationship of the administrative organizations and agencies under the Department; to manage the cadres, carry out treating mechanisms and policies, mechanisms on reward, punishment for cadres under the management scope of the Department according to the provisions of law and the decentralization of the provincial People’s Committee.

16. To carry out financial and asset management and organize the management and use of the budget according to provisions of law and the decentralization of the provincial People’s Committee.

17. To provide information, regular and unscheduled reports on the implementation of programs and projects on development of local industry and trade according to the stipulations of the provincial People’s Committee and the Ministry of Industry and Trade.

18. To carry out other tasks assigned by the provincial People’s Committee and according to the provisions of law.
