Workshop on 'Consumer Protection - Legal Framework and dispute settlement procedures in Viet Nam'

The objective of the workshop is to raise awareness on legal framework for consumer protection and assure better enforcement of regulations on the competition, rights and benefits of consumers in Viet Nam. The workshop was chaired by Ms. Nguyen Thi Hoang Thuy, Project Director of EU Viet Nam MUTRAP III, Mr. Antonio Berenguer, Trade Counsellor, Delegation of the European Commission to Vietnam; Mr. Lu Bang, Deputy Director Department of Industry and Trade of Da Nang. The team of speakers was composed by Ms. Vu Thi Bach Nga, Head of Consumer Protection Division, Viet Nam Competition Administration Department; Ms. Dinh Thi My Loan, Viet Nam Standard and Consumer Association (VINASTAS). The workshop was attended by more than 100 representatives from many organizations and enterprises in Da Nang. Many practical and interesting issues paid attention by Vietnamese consumer community were discussed in the Workshop: rights and responsibilities of consumers, detailed regulations of the Ordinance on Consumer Protection; the consumer protection policies in Viet Nam; handling and settling consumers’ disputes; collective proceedings to redress consumers’ disputes in Viet Nam; the structure and functions of consumers’ protection organizations in other countries, learned lesson for Viet Nam… As discussed and agreed by participants, up to now there have been many legislative documents related to this subject, however they were incoherent, overlapping, ineffective, unfeasible and do not reflect expectations and requirements from consumers who are facing to various harms caused by right violation. Therefore, it is necessary to have a legal system consistent and effective that supports firmly to the consumer protection mechanisms, including State Administrative System and Consumer Protection Associations. The key point is that the legal system should be consumer-centered and it should have a mechanism for the consumers to protect themselves... Besides, the post audit mechanism should be implemented by activities of control, inspection and handling with violation to the rights of the consumer. The workshop concluded that there were initial efforts and remarkable achievements, however, the consumer protection in general and consumer legal framework in particular still have many shortcomings and inadequateness. It is important to have new orientations and approaches in order to ensure the efficiency of the consumer protection in which the improvement of consumer protection legal framework is of high priority by its actuality, theoretical and practical significance.
